Please read these Terms and conditions carefully and make sure that you understand them, before using or ordering anything from our website or from our store. You should check this page on a regular basis for any changes we may have made to the Terms of Service.
Should you disagree with them or any part of these terms and conditions conflict with your opinion, please do not proceed with your order or using our website.

TERMS OF SALE
By completing and submitting the electronic order via this website you agree to these terms and conditions. If you refuse to accept, you will not be able to order anything from our site.

CONTRACT
By completing and submitting your order you are making an offer to purchase goods that, if accepted by us, will result in a binding contract.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved us and we have debited your debit card.

In order to contract with Create A Cake you must be over 18 years of age and possess a valid debit card issued by a bank acceptable to us. Create A Cake retains the right to refuse any request made by you and the right to close your account at its sole discretion.

When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
Once an order has been despatched we cannot change the delivery address from that originally stated on the order.

PRODUCT PRICING
All prices on stated on our websites are inclusive of VAT at the current UK rate (where applicable).
All prices advertised are subject to change. We try and ensure that all prices, product details and descriptions that appear on our website are as accurate as possible. Our site contains a large number of products. It is always possible that, despite our reasonable efforts, some of the products on our site may be incorrectly priced. We reserve the right to correct any errors, inaccuracies and to change and alter this information at any time without prior notice. We reserve the right to refuse to fulfill any orders that you place that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
If we discover an error in the price of a product within your order, we will endeavour to inform you as early as possible. We will then give you the decision of either reconfirming and going ahead with your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

DELIVERY
Dispatch times may vary according to availability and any delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery page for further information.

FAULTY OR DAMAGED GOODS
Create A Cake offers no-quibble money-back guarantee for any products found to be faulty. Where goods are damaged in transit Create A Cake will replace the item free of charge.
If any of your products are delivered faulty or damaged, please contact Create A Cake to be reported on the day of delivery by telephone or use our online contact form. Please provide as much information about your order as possible to help us with your investigation. We ask that damaged products are returned to Create A Cake registered office in the original packaging if possible. Create A Cake will reimburse postage costs of the return of faulty goods to the customer. We may also ask for proof of the damage and a written statement so that we can proceed with a compensation claim against the courier.
Please note that all damaged or missing items must be reported on the day of delivery.

PRODUCT RECALL
Please be assured Create A Cake remains committed to the highest levels of product safety and standards. From time to time we may find an issue with one of our products, to make sure you only have our best products, we'll post any updates of any product recalls within this section . We apologise in advance for any inconvenience this may cause.

PRODUCT INGREDIENTS & ALLERGY INFORMATION
Whilst every care has been taken to ensure the accuracy of ingredients and food allergy information provided on this website, we ask customers concerned about food allergies / ingredients to always check the manufacturers label/s on the product. From time to time manufacturers ingredients may vary / change without notice. Create A Cake will not be held liable for any customers who disregard manufacturers label/s.

GIFT VOUCHERS
Gift vouchers issued by Create A Cake are redeemable in our store only. They cannot be redeemed for online purchases on our website.
Create A Cake gift vouchers may only be exchanged for goods to its value in store only. No change will be given. Some products, areas and concessions may be excluded from the offer. Ask in store for more details.
Gift vouchers cannot be refunded or exchanged for cash.
Lost, damaged or defaced vouchers will not be accepted or replaced.
Any unused balance will be recorded against the voucher.
If the transaction in store exceeds the amount of the gift voucher, the outstanding balance must be paid by the customer.

From time to time we may offer promotional discount codes which may be used on certain specified, purchases made though this Website. The conditions of use relating to any discount code will be specified at the time of issue.

These T&Cs relate to all Create A Cake promotions, competitions and discount codes (unless otherwise stated).
Only one promotion code can be used per online order.
A promotional code can't be used after an order has been placed.
If the end date of the promotional code has passed, then it cannot be used and has unfortunately expired.
Promotional codes cannot be exchanged for cash.
Promotional codes should be kept confidential and only be used for your own purchases through this website, they should not be circulated around family and friends or posted in forums.
If a promotional code is misplaced, we are not obliged to provide you with a replacement and abuse of the code if it inadvertently gets lost and used by someone else will result in its cancellation.
Specific brand or product category exclusions may apply. We will let you know if the promotional code can’t be used against certain brands or product categories in your basket before you complete your purchase.

CAKE DECORATING CLASSES
Class space is limited, so we must receive a non refundable deposit at the time of booking in order to secure a place.

Classes Cancellation Policy
Create A Cake Sugarcraft Suppliers reserves the right to cancel or change the nature of all courses. In the unlikely event of a class cancellation, Create A Cake Sugarcraft Suppliers will give students as much advance notice as possible and offer a full refund of the cost of the class only. In the case of a date rescheduling, students will be given the option to transfer to the rescheduled class or a full refund of the cost of the class only. For those who opt for a full refund, please be advised that Create A Cake Sugarcraft Suppliers takes no responsibility for travel or accommodation expenses incurred.

Classes Refund Policy
Create A Cake Sugarcraft Suppliers is unable to offer refunds on any courses booked.
Transfers to another class may be approved, but only in extenuating circumstances and at the sole discretion of Create A Cake Sugarcraft Suppliers. In these cases, Create A Cake Sugarcraft Suppliers must be advised in writing at least 2 weeks prior to the commencement of class.
In the event that a student is unable to attend a class and would like to send a substitution, he/she must notify Create A Cake Sugarcraft Suppliers in advance.

Classes Discount Policy
Create A Cake Sugarcraft Suppliers may occasionally offer special promotional priced places relating to specific classes. The promotional rate will be available for a limited time only and will only be applicable to places booked within the clearly stated dates. Class places booked before or after the sale dates are not eligible for discounted rates.

Class Materials & Equipment
Create A Cake Sugarcraft Suppliers will provide all materials and equipment required for the class, unless stated otherwise.
All tools and equipment used in class remain property of Create A Cake Sugarcraft Suppliers and should not be removed from the teaching facilities. Certain tools and equipment used during class may be available for purchase at the conclusion of the course.

Class Student Conduct
Students are expected to be courteous and respectful of their peers and tutors.
Students are required to wear solid, comfortable, close-toed shoes such as trainers (please no sandals or high heels). Students are advised to avoid wearing jewellery, as well as warm and bulky clothing during class, which may become safety hazards. Students should have their hair neatly tied back at all times.
Create A Cake Sugarcraft Suppliers will provide aprons to all students.
Students are welcome to take photographs of demonstrations and of their work, but videos and other recordings are strictly prohibited.

WEDDING CAKE & CELEBRATION CAKE ORDERS

All cake orders placed with Create A Cake on the shop premises or via any other method (including email & social media channel messages are subject to the below terms and conditions.

Cake Order

Any information given whilst placing your order, including design details, colours, theme, contact information, price etc will all be included for reference and approval on your cake order form.

It is the customers' responsibility to ensure that any detail given/printed on your order form is correct. By paying your cake order deposit, you are confirming all detail is correct and that you accept the Create A Cake terms and conditions.

Once your order is being created, it will strictly follow the information given on your order form. Verbal orders will never be taken, all orders must be confirmed in writing.

Cake Order Notice Period

Our cake diary fills up very quickly, to avoid disapointment we recommend booking your cake order as early as possible. We have a minimum of 2 weeks notice required for the majority of our orders. However, we may be able to produce last minute orders depending on the requirements and orders we have on that specific date.

Cake Price

The total price for your cake order will be stated on your cake order form. By paying your cake order deposit, you are confirming and you agree to pay the full price stated on your order form to Create A Cake. For wedding cakes the full payment is required at least 4 weeks prior to collection/delivery date. For other celebration cakes full payment deadline varies, please speak to a member of staff if you are unsure.

Cake Design

Any cake ordered based on a photograph of a cake made by another cake maker, can only be reproduced as our interpretation and will not be an exact replica of the cake in question.

The colour of your cake order will be matched as closely as possible to the design agreed. However may not be identical to those displayed in our showroom/online. Any photographs displayed on our website or on our social media channels are a guide only and the final cake design may vary slightly to these.

All sugarpaste figurines. models and toppers are handmade on our shop premises. These are not manufactured and may sometimes vary slightly to those displayed in our showroom/online.

In some extremely rare cases it may be necessary to slightly change or vary a design from what has been agreed, as specific cake decorating items may become unavailable/discontinued from our suppliers. If this occurs, we will ensure a substitute replacement is found with an equally or better quality product.

Portion guides are only approximate and dependent on correct cutting (Our recommended portion size is 1” x 2”). We cannot be held responsible for shortfalls in portions.

Cake Contents

Some cake designs contain non edible items and decorations, such as broaches, ribbons, flowers etc. Sugarpaste figurines and floral cake toppers may also contain wire, crystals or beads which should not be eaten. It will be your/your caterer's responsibility to remove these, as appropriate, before serving your cake.

All cake orders are made fresh on the premises with the highest quality ingredients.

All fruit cakes contain nuts, or traces of nuts. Every effort is taken to keep any ingredients separate, however please be aware that although your cake order may not be made with nuts or a nut product, it will be prepared in a kitchen where nuts may be frequently used. We cannot be held responsible for any ingredient contaminated at source and we do not accept any liability for any damage to health or any distress caused to you by the consumption of such products.

Cake Order Changes & Alterations

We do our best to accomodate any changes or alterations you wish to make to your cake order up until 4 weeks prior to the delivery/collection date, however late changes can't always be guaranteed. It is the customer's responsibility to confirm in person any alterations to be made to the original cake order with the business owner/staff member.

Create A Cake reserves the right to amend the final cake order price in line with any alterations to the intitial agreed design.

Cake Deposit

Cake order slots in our diary are limited, all cake orders require a non refundable deposit at the time of booking in order to secure your place. For cakes with less than 4 weeks notice, half the cost of the cake must be paid at time of booking.

All deposits become due when the order has been placed and details checked and agreed by the customer. All orders are deemed to have been accepted once the deposit has been paid. Your deposit payment can be made by cash or credit/debit card. Please note that all deposits are non-refundable and non-transferable.

Final Payment

For wedding cake orders, the outstanding balance of your cake order must be paid 4 weeks prior to your collection/delivery date, unless discussed otherwise with business owner/staff members. If the final payment has not been made by or on the due date your order will not be made and will result in cancellation.

Cake Collection

Your cake order should be collected at the time agreed when placing your order and stated on your order form. If for any reason you are unable to make this agreed time, Create A Cake must be informed with sufficient time to re-arrange. We do not take any responsibility if your order fails to be collected on the arranged day due to issues with business opening hours.

All cake orders will be pre-boxed for the customer for transportation. Customers are advised to check their order at the time of collection, once received we will assume the customer is satisfied. After the customer has received the order it is the sole responsibility of the customer. We will not accept responsibility for damage caused by you or by any other persons nominated by you to collect your order. Any repairs or adjustments will incur additional charges. Once the order leaves our premises, we cannot be held responsible for any damage.

Cake Delivery & Set Up

We will only deliver wedding cakes within a 40 mile radius of the shop premises, any further than this increases the possibility of damage in transit due to lengthy travel.

A delivery charge, if requested will be given at the time of placing your order. This will be based on distance required to travel, date, time and also include the cost of the safe installation and set up of your cake.

Venue parking should be available for delivery. If unavailable, any parking fees will be added to your final payment.

If you have a specific delivery date and require delivery before a given time, please ensure this is specified when placing your order.

It is the customer's responsibility to ensure the correct delivery information is given and that pre-arrangements have been made with the venue for the location and display of your cake. Set up does not include cake table or area decoration.

Create A Cake cannot be held responsible for the location of the cake at the venue. Please ensure, that the display location is level, stable and strong enough to hold the cake. If the order is to be left unattended at the venue, we cannot be held responsible for any damage or loss occurring after we have left the venue.

We reserve the right to photograph the order on delivery and these photographs remain our property.

On occasion we are faced with severe weather conditions or other unexpected events that may make your venue inaccessible. We will always do our best to deliver as pre-arranged.

In the unlikely event that our delivery vehicle becomes involved in an accident, and your order gets damaged, we will provide you with a full refund which will include the cost of the order and delivery fee. We will not be liable to any further charges.

Cake Cancellations
As your cake order is reserved and designed soley for you, certain elements of your cake order may be ordered months in advance. Under the Distance Selling Regulations you do not have the legal right to cancel a made-to-order item, which includes edible goods. Depending on the circumstances, time and expense we have invested at that point any monies paid may not be refundable, we may cancel your order at our discretion.

If you require your order to be cancelled the following apply:

More than 4 weeks from delivery date - 25% of the total cost will be payable
0 to 4 weeks to delivery/collection date - 100% of the total cost will be payable

All cake order cancellations must be made in writing to Create A Cake.

If the customer fails to make the complete order payment by the date agreed (4 weeks prior to delivery/collection date), Create A Cake reserves the right to automatically cancel the order.

Create A Cake also reserves the right to cancel if we have insufficient stock or staffing levels to deliver the order. In the unlikely event of a cancellation, Create A Cake Sugarcraft Suppliers will give customers as much advance notice as possible and offer a full refund of the cost of the cake order only. In the case of a date rescheduling, customers will be given the option to transfer to the rescheduled date.

Cake Discount Policy

Cake Storage & Consumption

At Create A Cake, we take pride in lovingly baking each and every cake sponge on our shop premises, so we know exactly what goes into them. Your cake is baked to ensure it is fresh for the date of your order only, we cannot guarantee its quality if it’s consumed more than 48 hours after collection/delivery. We are therefore unable to make a warranty as to the length of time for which the cakes will remain fit for consumption. We do however, recommend our cakes are consumed within 48 hours from collection/delivery.

Your cake should not be refridgerated, this will cause condensation to form on the cake's surface/icing and will accelerate the staling of the flour within the cake. Any cake should be stored in a cool, damp-free, dry environment, out of any direct sunlight and on a flat, sturdy surface. Create A Cake is not liable for any cakes stored or displayed in poor conditions. It is the responsibility of the customer to keep the cake in the manner recommended by us. Orders placed in a fridge or kept for a time longer than recommened are done so at your own risk and we are not liable for any deterioration of the order in these circumstances.

Freezing your cake preserves the taste of the sponge and icing as much as feasibly possible, but please bear in mind that it will affect the visual appearance of the icing, as condensation will form upon defrosting. Food hygiene recommendations recommend that food should only be frozen for a maximum of 3 months.

Refunds and Complaints

For every cake order made, the order deposit is non-refundable.
Create A Cake Sugarcraft Suppliers is unable to offer refunds on any cakes booked.Transfers to another cake order may be approved, but only in extenuating circumstances and at the sole discretion of Create A Cake Sugarcraft Suppliers. In these cases, Create A Cake Sugarcraft Suppliers must be advised in writing at least 6 weeks prior to the original cake date.

In the rare event that your cake fails to meet our commitment to quality, a refund may be offered at our discretion.

If you have concerns about your cake, please notify us upon collection/delivery of the cake so that we have the opportunity to rectify it in time for your event. Any complaints should be made within 24 hours of receipt of the cake(s) to be eligible for any form redress and if you should wish to request a refund then you must allow part or all of the cake, upon our request, to be collected by us to allow us to investigate the complaint.

We take all complaints seriously however we ask for patience with factors that may be beyond our control (e.g. traffic conditions etc.) as we cannot be held liable for any such delays. We will endeavour to resolve all complaints within 5 business days of receiving them.

In circumstances where a refund is offered, it will be limited to the value of the cake in dispute. Additional avenues of recourse other than mediation, whether it may be further compensation or otherwise, is not available.

As taste is a very personal matter and subjective we cannot accept the return of any orders merely because you do not like the taste.

Any Refunds are at the discretion of Create A Cake.
